Big Win for Gun Rights in California,-California---State-Capitol_(cropped).jpg

A 2019 news report revealed that in 2018 there were “1,515 deaths by knives or cutting instruments” as compared to “297 killed by (any) rifles,” according to public FBI statistics.

These are numbers you won’t hear or see reported by mainstream media, and the political Left certainly won’t reference these statistics in their push to disarm the American public.

Fast forward to 2021, however, and the Daily Wire reports on the outcome of Miller v. Bonta, in which the Firearms Policy Coalition challenged California’s ban on semiautomatic firearms. Last Friday’s ruling by a federal judge in the Southern District of California proves a big win for 2nd Amendment rights.

The opinion issued by Judge Roger T. Benitez regarded the popular AR-15 as “a perfect combination of home defense weapon and homeland defense equipment,” holding that the ban on “AR-15 type rifles” is unconstitutional.

Judge Benitez goes on to aptly say that “One is to be forgiven is one is to be persuaded by news media and others that the nation is awash with murderous AR-15 assault rifles. The facts do not, however, support this hyperbole, and facts matter.”

Despite what liberal lawmakers may lead Californians to believe, 252 people were murdered by knives in the state of California in 2019. Conversely, 34 people were killed with a rifle, and not necessarily an AR-15.

These facts provide weak justification for the outlaw of AR-15 rifles for Californians. Such a ban serves only to undermine the 2nd Amendment right to bear arms.

“While this victory is most certainly a valuable one, it’s also important to understand how impactful this decision will be in restoring Second Amendment rights not only in California, but across the entire country,” noted FPC Attorney John Dillon. “This landmark trial win points the way to victory everywhere these unconstitutional bans exist.”

From Friday’s ruling, “There is only one policy enshrined in the Bill of Rights. Guns and ammunition in the hands of criminals, tyrants and terrorists are dangerous; guns in the hands of law- abiding responsible citizens are better.

To give full life to the core right of self-defense, every law-abiding responsible individual citizen has a constitutionally protected right to keep and bear firearms commonly owned and kept for lawful purposes.”

In a national political climate where gun rights are increasingly coming under fire, California’s most recent ruling stands as just one win in an ongoing battle to protect constitutional rights across the country.
